Dependent is not eligible for ILR along with main applicant

Dependent is not eligible for ILR along with main applicant

Hi,

Main applicant (Tier 1G) is eligible to apply for ILR.
Wife (dependent of Tier 1 G) is not eligible for ILR because the dependent has not been stayed 2 years in UK.
The dependent visa is still valid for one more year.

So what the dependent should do after the Tier 1 holder gets the ILR?

1. Can the dependent switch the visa from "dependent of Tier1" to "dependent of ILR"?
2. If so, should the dependent change the visa immediately after the Tier1 holder gets the ILR? Or can the dependent wait until the visa expires?
3. Should the dependent clear the English Language Test in order to switch the visa?
4. The university where the dependent studied the Bachelor's degree is present in the Point Based Calculator (though it gives 0 points). Does it mean that the English language test is not mandatory?

Please could you share your thoughts.

Days out of UK condition only applies to main applicant not dependent so she will get ILR as your dependent.

Answer to your questions are below.

1. yes once you ILR is done dependant need to apply for visa as dependent of ILR.

2. Change the visa immediately after the Tier1 holder get ILR

3. Not Sure but I think dependant don't need English language test at this stage.

4. answer at point 3

I need advise on the same as well as it is exactly the same situation..

Valid till

Main appl :- 4th Dec'13
Dependent :- 4th Dec'13

Can you suggest.
