URGENT: Got a short term full time job. Can I NOT switch?

Post by LWS » Sat Jan 19, 2013 11:28 pm

I am currently on my first year with PSW visa. Yesterday I got offered a prestigious job offer. It's full-time for 9 months. I am eligible to switch to Tier 2. I am wondering, if I get the tier 2 visa will it cover only the duration of the job? Or will it be 3 years? If its on for the 9 months, can I choose not switch as the PSW validity period will cover the 9 months. I'd rather have a year and a half valid visa (what I have left on my PSW) than 9 months one (tier 2).

A Tier 2 G will only be valid for the duration of your new job. All Tier 2 visas are directly tied to the job you have, very much unlike all Tier 1 routes. So even if it were somehow valid for 3 years, it would cease to be valid if you left your role with your employer.

Given the info you have provided, stick with the Tier 1. The only way you might be advantaged is because all time spent on a Tier 1 or student route only counts towards long residency. Your 5/6 year clock would start if you switched to Tier 2.

If the temporary job did somehow become permanent, you can always apply for a Tier 2, but if at the end of the 9 months, you are left without a job, you could still find a new one on your Tier 1 PSW.

Good luck.

Thank you so much for your informative reply Physicskate. That's reassuring that I can choose not to switch. So under the PSW visa, can I work full time (currently 41 hours) without hour restrictions?

Yes. Surely you read the restrictions when you applied for the visa in the first place??? In fact, the restrictions are pretty much zilch...

Thanks. I did read everything I could about PSW but just wanted to make sure as my new employer mentioned that there were restrictions in the hours but I've just resolved that as they were thinking student visa not PSW. Anyway, thanks. I'm looking forward to starting work and I hope it goes permanent at some point.
