hi im currently on tier1 general, expiring on 11/03/2013, my maternity leave started on the 13 august 2012 and my employer sent me p45 on 2nd nov 2012. she paying me still SMP. im self employed as well from jan 2012 till date. to show 35000 plus earning can i show income from self employed business while on maternity leave, as i dont hve enough earnings from job. or can i find a new job before applying for extension of 3 years. will self employed will be fine to earn points.
plz help me with this. i shall be really thankful to ur useful response.

It works like this. You can break your 12 month earning period with a period of maternity leave, and claim income from a 12 month period that falls before or either side of that break. But if you do this, you can't then claim for any SE income that falls within the defined maternity leave period. Alternatively, you can ignore the maternity leave and simply claim the uninterrupted 12 months with the income before you were on maternity leave, with SE income acquired while you were on maternity leave.

the employer has paid me maternity for these months, it shows in my account, but she also terminated my fixed term job from 2nd nov, still paying SMp for 39 weeks.P45 given to me in an email. also i will be applying for my baby, if i dont claim maternity leave, will home office object on this that SMP is coming for part time job. shall i just fill in last 12 months and ignore the maternity leave even i had baby born in oct 2012. plz reply, shall be really thankful to u, as its all vry confusing.

The UKBA will want you to score points and what income you use to score points is entirely up to you.

hi, i hve another question hope you can help me. i need to do tax return for the year 2011 to 2012. i do nt have 35000 income in that period also i did nt do transcation fro march 2011 to dec 2011, as i received my visa in that year. can i do tax return on amount less then 35000 as according to my 20 points requirenments. this last 12 months i hve done transaction bt nt the year before i need to do tax return.
