My son status while I am applying for ILR

Dear All,

My son (18months old) is currently staying in the UK as a dependent under my Tier 1 visa. His visa (and myself) is expiring in March this year.

So, I will be applying for ILR (via postal) for my wife and myself next month. Can I exclude my son in the application and apply citizenship for him after we got the ILR?

Is he staying in the UK legally while we are applying for ILR? His current visa will expire while we are waiting for ILR approval.
