Job opportunity but no sponsor license yet

Post by MarcoPolo » Wed Jan 23, 2013 12:05 am

Hi Everyone,

Please help me with my problem.

I'm currently on a Tier 2 General visa and have been notified that I will be redundant after a notice period of 3 months which ends in April 2013 (So in general I have 3 months + 60 days to find an alternative employment).

Luckily, I had a very successful interview this week and the company is interested to hire me. However, the problem is that they don't have a sponsorship license at the moment but they are willing to get one. I was told that getting a sponsor license can take up to 5 months and I cannot wait for this long as they need someone to start as soon as possible.

My questions are:
1. The company is a new start up company (10 employees) - How easy do you think it will be for them to obtain the license?
2. Are there ways to speed up the process of sponsor application?
2. Assuming the company will apply for a sponsor license and has a good chance to recieve it, does anyone have any ideas for how can I work for the company from now and until they will have the permission to employ me (part time or full time)?

This is a very good company and great opportunity that I don't want to miss so I would really appreciate if anyone can give me an advise on this.

Many Thanks,

MP

I was hired by new company over 9 months ago. I still don't have my visa. Timelines seem to have improved for getting a sponsor visa (recently has been more like 1-2 months).
1.) There may be some difficulty with them having the paperwork that the UKBA require. This is something only they will knoe.
2.) the only way to speed up the process is if your visa is imminently expiring. There was a time when you could apply for urgent consideration 15 business days before the expiry of your visa (you would have to send proof that your visa was expiring). Also, they might not immediately notify you of curtailment of your visa. They have never told me they did with my old one (long story).
3.) The rules say you are allowed to take supplemental work and voluntary work as long as it does not impinge on the work you are sponsored to do. It is very unclear as to how this works if transitioning from one company to another, and in particular once you are no longer doing the job you were here to do (does one stop volunteering at a charity shop, for instance, if you leave your job before the new visa comes through?). http://www.ukba.homeoffice.gov.uk/visas ... onditions/
