Post by oam » Wed Jan 23, 2013 11:28 am

My company got extend action plan and remain rated B. If we correct all mistake we made in previous visit. Will they rerate to A? What will they do if they still not satisfy? If they withdraw our license, Could we reapply? Will they put us as blacklist?

Specifically, with regard to your circumstances, it is not possible to make predictions.

There are general procedures that you may read about here:

If you don't meet the requirements of the action plan they will probably revoke the licence. You can re-apply but they'd probably do a pre-licence check to make sure you meet the record-keeping requirements etc.

Thanks for the reply. Will they tell that they will revoke your license when they visit?

They probably won't specify when they do a visit what the outcome of the visit will be (this is because a sponsor might get angry and violent if it's a refusal - they'd rather do refusals by letter). But the sponsor should be able to tell from the way the visit goes whether it went well or not.

If the visting officer says "show me how you track your migrant workers" and the sponsor has nothing to show them, or their records don't meet the requirements of Appdx D then it's pretty obvious they will be downgraded or revoked.

We had been downgrade once then we paid for action plan they came last year to check. I wait 1 year for reply then they said they will come to check again. What I did follow action plan but they still not believe what we did. As one staff they had a request for without paid holiday as he used up all holidays in that year. They accused me of underpaid. One staff just arrive and not on the job properly, therefore he want to work longer to finish his job. When they come interview they find he work longer hours to contract. They don't ask me at the premises for reason. Will it take long time to revoke? I need to apply for COS in November time. Is it better to surrender my license then wait 6 months to reapply.
