im just exercising my treaty rights will i get RC still

Hello everyone i applied for EEA2 RC and get refused i am appealing it next month but my solicitor is rubbish because my husband and i did not know about this treaty rights and now by reading this site we do. so my husband is going to register as a business starting this year do you think if we have all the necessary documents in court they will still give me my resident card even though my husband just started to exercise his treaty rights because when we made the application last year he was not exercising his treaty rights and we did not know so we send in an appeal and now we are trying to come up with every proof we can to say he owns his own business before the appeal date. help me please i need to know where we stand.
