UK spouse to claim income support couple one on work permit

My UK spouse needs to claim income support as a couple but I'm here on a work permit only with no recourse to public funds. We have a 3 years old child. Do we claim just one person and child to receive funds on couple claim?

Well I suspect no Income Support claim is made at all. That is assuming that you are working, and you live with your spouse.

Instead there is a possibility of a claim for Tax Credits.

if you are earning, he (british/ilr) can claim tax credits / housing benefit, child benefit etc.

housing benefit will be paid as if he were a single man with a child.. your income will be classed as his income too.

the same applys for jsa/esa etc.

if he isnt working, put the child benefit in his name so his NI stamp is being paid. (but i would assume it is already in his name etc for "simplicity")

tax credits etc, you can claim working tax credits if you are working over 24 hrs a week average (so week 1 u work 20 hours, but week two you work 30 hours, your average is 50/2=25. (if you understand... it isnt a case that you must work 24 hours EVERY WEEK but your average hours must be 24 hours)
