fresh application as overstayer

My tier 1 entrepreneur visa application was refused just now..and my current visa (psw) has expired few months ago...i have lodged for appeal....in case if my appeal gets dismissed...can i make a fresh application then ?...i dont want to go back home as i wont be able to apply under 50k category....please help

if your appeal is unsuccessful than you wont be able to make fresh in country application also if you can please tell what was the reason for refusal as it will be helpful for most of us here.
