Hi Buntyz,

Student are only allowed to make in country application if they have access to £50,000 from following:

"Policy Guidance:

Para 22.If you are in the UK with permission to stay as:

• a Tier 4 migrant; • a Student nurse;

• a Student; • a Student writing up a thesis;

• a Student re-sitting an examination; • a Postgraduate Doctor or Dentist;

you are allowed to make an initial application in the UK (including switching from one immigration category to another) only if you have specific types of funding. You must have access to £50,000 or more from:

i) one or more registered venture capital firms regulated by the Financial Services Authority;

ii) one or more UK entrepreneurial seed funding competitions which is listed as endorsed on the UK Trade & Investment website; or

iii) one or more UK Government Departments or Devolved Government Departments in Scotland, Wales or Northern Ireland, which is made available by the Department(s) for the specific purpose of establishing or expanding a UK business.

(This is also referred to as a section b funding in this document.) Students without this type of funding are not permitted to switch into the Entrepreneur category in the UK."

hope this help

regards

Rehan

Hi, Sonia here.

As far as I can see, many people are still giving information based on old or expired provisions in UKBA's revised rules regarding Tier 1 Entrepreneur category.

Tier 4 Students can only apply for Tier 1 - Entrepreneur (Venture Capital). They cannot apply for £200,000 sponsor category. However, there is no restriction on level or type of job in this route.

With Venture Capital firms, you require proof of access of £50,000 funds. There are limited placements available when it comes to Venture Capital firms.

UKBA changed this rule on 13th December 2012.

Hi Sonia,

Check my above reply I have posted detail information from policy guidance regarding this and you are right student can apply but 50 K venture funds only.

Student can also apply under 200K category but in that case they can't make in country application.

Hope it help
