What are Civil Penaltys under UK Immigration ACT?

Post by MP1982 » Thu Jan 24, 2013 2:44 pm

Does anyone know what falls under Civil Penalty under UK immigration ACT.

I can see lot of confusions including my self when filling form SET (O) especially if you have had a penalty for things such as Bus Lane Contravention,

So it will be good if there is any link to a list of what are these penalties are,

From my research I couldn’t find any list and every time ended up seeing Civil Penalties based on hiring Illegal workers, Clandestine or working
illegally.

So does this mean Immigration Penaltys only apply to these areas?
Glad if seniors, members can share their knowledge and sure this will help most member in this forum,

Regards,

Thank you for pointing that out,
But nowhere in that document says what are penalties that fall under Immigration Acts (Unless I have missed that bit), only area is;

‘’Fixed Penalty Notices and Penalty Notices for Disorder do not form part of a person’s criminal
record as there is no admission of guilt and they therefore do not need to be covered by the
Rehabilitation of Offenders Act. ‘’

For example the below link says what are civil penalties for sponsoring migrant workers so just like that there should be a list indicating rest of the Civil Penalties under Immigration Act,

UKBA wrote:3.6 – 3.7 You must give details of all criminal convictions both within and outside the United Kingdom. These include road traffic offences. Fixed penalty notices will not normally be taken in to account, unless you have had more than one fixed penalty notice in the last 12 months. In that case you may wish to wait to make your application until you have no more than one fixed penalty notice in the 12 month period before applying. Drink driving offences must be declared.
If you have any endorsements on your driving licence you must provide the paper counterpart.

Please note that a driving conviction may not yet be disregarded despite any penalty points being removed from your driving licence.
However, found this on Naturalisation form

This includes road traffic offences but not fixed penalty notices (such as speeding or parking tickets) unless they were part of a sentence of the court. This includes all drink-driving offences.
Look for a similar case
