applying for ILR on second ancestry visa?

Post by rebeccamareeclarke » Sun Jan 27, 2013 3:27 pm

I arrived in the UK in march 07 but spent a year back in Australia msrch 08-march 09.
My visa was due to expire Jan 2012 but due to my year out of the uk i needed to apply for a second ancestry, which was received in 11/11
I have lived continuously in the uk since march 09.
When can i apply for ILR?
Thank you

indefinite lesve to remain before visa expires

The ukba websites states you can only apply for ILR when my ancestry visa is nearing expiration. Is this still the case for second visas?
I want to get a passport eventually, so can I skip the indefinite leave to remain section and apply for passport after second visa? I would have been here almost 7 years straight (3 months short)

1. The requirement for ilr is that you have spent 5 continuous years in the UK in that category so you don't need to wait until nearer the expiry of your visa.
2. Only British citizens can apply for British passports. In order to be naturalise as a British citizen you need to be free from immigration control (eg have ilr) for at least a year prior to the application. (unless you are married to a British citizen in which case you just need to be free from immigration control on the day of the application.
