New EEA2 application 6 month question

New EEA2 application 6 month question

Hi
Just looking at new 12.12 EEA2 form and few new interesting Section 10 questions
10.11. How long have you lived in the UK? Years Months

Please provide details of any periods of absence of more than 6 months during that time.

10.12. Please state what ties you have with;
• The country where you were born
• Any other country whose nationality you hold
• Any country where you have lived for more than 5 years
You should tell us about any family, friends, or other connections with that country.

I am very curious what they trying to get?
10.11 what is 6 month represent is it in total of time outside or at once?
e.g. been in uk 7 years done many trips ,holidays work ect. but none of them more than 6 month. So do I need to list all of them? Surely it is if I been outside of uk more than 6 month at once.
It is so typical of UKBA no guidance at all

and
10.12 How legal is it ? Do we have a private life after all this questions ?

You can ignore questions which are so obvious irrelevant.

The issue about being absent for more than six months during a year is only relevant for PR applications (EEA3 and EEA4)

why did they include it than?

So far as i know, there are no provision in the Directive or the EEA regulations, for mandatory refusal if those questions are not answered.

Therefore individuals who are uncomfortable answering, should not answer it.

I believe the 6 month, or 12 months absence is relevant for a PR application, therefore it is open to people to fill that section, to save the decision maker the time of enquiring from alternative source, if you have break the continuity of residence.

Just put not applicable period! EU Directive gives right to question that are not partinent to the Union in question because it will deraiedl the effectiveness of its rules.
