very confused about wifes refusal and case please help

very confused about wifes refusal and case please help

Ok basically, i am British born citizen and got married in August 2011 to my wife in Pakistan. She now has a child who 7 1/2 months also.

Initially the paperwork was fine except that she had been wrongly informed in regards the type of english test she needs to sit. She sat the test IELTS i think it was called which is specfically for those who want to enter the UK as students. On this basis her application was refused for not being able to meet the requirements.

Apparently we would like to appeal? I am usnure as to what is exactly happening but need some advice on what to do next.

My wife in Pakistan submitted an appeal? Today we have made a payment of £140.00 for an Oral hearing of some sort.


Now i am of the understanding there are two types of hearings; a paper one and an oral one.

Whats the difference?

I have her new certificate here (passed the test and meets the english language requirements). What do i need to do now? Should i get all the documents (the rest of the paperwork) and send them to the place in leciseter here? Or do we take them to the hearing? Or do they have to be submitted in Pakistan. Also how much will this all cost if we go to a solicitor?

A new test after a decision to refuse a visa may not be considered as it is not something that existed at the time of the decision to refuse. Post-decision evidence is not generally considered. I suggest a new application would be a better option than a six month wait to learn the original refusal remains.
