Tier 2 ILR absence letter

Post by waqas.sabir » Mon Jan 28, 2013 7:37 pm

Hi
I will be applying for ILR in a month time but got a question on the letter from employer to confirm the absences including the annual leave.

Actually I have worked for 2 employers one I am currently working with since 2010 before that I have worked with different employer from 2008 till 2010. Do I need to get a letter from both employer or just from the recent employer to confirm the absences as annual leave or business need.

Second question is will it be safe to apply for dependant PEO if spouse has spent only 22 months and 2 weeks (current requirements is 24 months and can apply 28 days before) at the time of making application.

Regards

Whether or not you require an employer letter(s) to confirm your absences depends on the immigration category you will be applying for ILR under.

You would need a letter for absences if you are applying for ILR under Tier 2 category. If you have worked for different employers, you should try and get it from both the employers.

thanks for the reply guys.. Yes I will be applying for ILR under Tier 2 category. If I am not able to get the letter from previous employer will that have any impact?? also if you could please reply on the second question because my spouse entered in may 2011 and her visa expires in april 2013 hence she will short of approx 2 weeks by the time we go for PEO appointment in March 2013. will it be safe to do that or should I go for PEO appointment myself and apply for her via post??

visa applied November 2010
visa refused dec 2010
Appealed against the decision Dec 2010
Decision overturned march 2011
Visa stamped (valid from) 11/04/2011
First Entry 06/05/2011
valid until 05/04/2013

As you can see she will only be completing 23 months just a day before her visa expires and my 5 year completes on 31/03/2013 and we will be applying say around 20th march. She will short approx around 2 to 3 weeks will she be OK applying at PEO?? an urgent reply will be appreciated.
