leave to remain after EEA

Post by clairez22 » Wed Jan 30, 2013 8:23 pm

Sorry not sure if this post should be in here or the ILR section, so put into both.

I need some advise on how the process now works and getting nowhere fast with the UKBA!

Me - UK british Citizen
Husband - Moroccan

Both living in spain for 4 years & married there

applied in spain for EEA family permit to come to live back in the UK

Been in the UK almost 3 years, and on 2nd EEA 1 permit.

I am a Uk citizen but we had to apply for EEA due to me bein resident in spain.

What I need to know is if we are able o apply for ILR having now been here 3 years, and if we can, do you apply for ILR before 3 years is up or not until 3years is compelted?

Thanks

As your husband is on the European track, in general, he will need to wait five years before securing permanent residence.
