ILR application for child under 18 with spouse

Post by alok_singh » Thu Jan 31, 2013 8:04 am

Hi,

I have got my ILR via economic route in 5 years.

I had not applied for dependant in my application since was not sure of outcome.

now I want to apply ILR for spouse along with child under 18.
my spouse is in uk from July 2009

she went outside from
1. 5 jan 2011 to 17 apr 2011 = 102 days. will this break 2 yr continuous residence?
2. 3 Jul 2012 to 27 Jul 2012 = 18 days

I know I can go via MN1 route for child but I wish to apply for ILR and naturalization together .

Can SET(O) form be used in child as Dependant and spouse as main application . Although child application need to be based on mine for which their is no mention in the form.?

please help. I have in person appointment on 11th feb in Cardiff

Hi there,
I learned from this forum that you need to use SET(O) form for each of your dependant (and individual fee, you cannot include your child as your wife's dependant) and they need separate individual PEO appointment.
However,If you seek for the right form in the UKBA's web site you'll end up with SET(M) for spouse and SET(F) for a child!!

Oooh , meaning I need to spent 1377 to every dependant ILR or 991 in postal and wait for 6 months.

but SET(M) is only for the dependant who are already on existing leave of patner of a settled person in UK.
