visa for son of british mother.inside the uk.

hi everybody.I was born in pakistan after my father got british passport.I applied for bc when I got married in pakistan n got it when my son was 1 year old. I brought my son to uk on 2 year visit visa .I started to work. my son regularly visits pakistan in every 6 months period with me.after 1 year my husband applied spouse visa from pakistan n got 2 years spouse visa in october 2013.now he is in uk. my son visa is going to expire in november 2013. now I am quite confused in which category I need to apply his visa n who is going to apply ? father or mother .as my husband has been in the uk for the last 3 months .can i apply ILR or bc for my son .my son is 4 years old .plz if any body know the answer. I will b grateful.

thanks alekos for your help. I read the link you sent me. I think my son's comes under 3 (5) section but the problem is that I didnt have bc when my son was born. I had just applied at that time n was wating for the reply. 2nd problem is my son is on visit visa right now.can he switch to another category . moreover my son has not completed his 3 years in the uk which is one of the condition for section 3 (5). plz help. is he eligible for bc.does my son comes under dependent visa category?. plz help.

I suspect that you need to apply for a Child Settlement visa for your child, which in view of the fact that you have British Citizenship, will be granted as ILE ..... indefinite leave to enter.

Then at the appropriate time make the section 3(5) application that you mention.
