UK citizenship

Post by SugarBoy » Fri Feb 01, 2013 10:07 am

Brief background: My spouse & I got married in 2003 in our country of origin in Asia. My spouse came to UK on work permit in July 2007 I accompanied my spouse as accompanying /dependent spouse. In July 2012 my spouse successfully got ILR & I also got ILR as accompanying / dependent spouse. From 2007 to 2012 on every occasion of visa renewal (WP, T2, T1G)it has been a case of my spouse being the main applicant and I being accompanying / dependent spouse. Now we are at the stage of applying for UK citizenship in July 2013. I have had to travel between our country of origin and UK since 2008 to present since my old widowed mother had suffered a stroke in 2008 & as a result I may not meet the days spent in the Uk / residence requirement over all the five years due to my absences which were more in 2008 but the absences reduced in 2010,2011 & 2012.

Question: In the light of the above, Since I first entered the UK as accompanying / Dependent spouse of the Main Applicant and have had the same status at the renewal stage as well. Now can I wait for successful completion of my spouses UK citizenship application & upon successful completion of my spouse's application thereafter can I apply as the spouse of a UK citizen applying for UK citizenship since the qualifying period for such cases is three years since I will meet the number of days in the UK over this qualifying period of three years viz 2009 - 2012. Am I allowed to do this or not under the immigration laws?

I am confused, pl guide/ help. Regards & thanks in advance.
