Wifes leave to remain visa refused

Post by searcher2 » Fri Feb 01, 2013 8:46 pm

Hi,
My wifes leave to remain visa has been refused and it says there is no right to appeal, is this correct?
She has had 2 previous leave to remain visas granted but when i applied for this one i used a visa application i had downloaded a couple of months previous not knowing the fees had gone up, by the time they got back to me and i had re-applied with the correct fee her current visa had expired and this seems to be the reason its been refused. What can we do?

i wonder why they can tell early as the visa already expired. Stupid! u dnt have the right to appeal. I think ur wife needs to go home and reapplied on her own country. Did they say about that?

I'm going to get some legal advise on monday, i think she may have a chance as she did actually apply whilst her visa was valid but they said it was invalid as they had increased the price by £10-£15. If we had not applied at all until after it ran out i think she would have had to leave the country.

After talking to a couple of lawyers and being told the chances of getting the visa application through is quite slim we are going off to Thailand and doing a new application there. Nice to get a holiday but not good for my bank balance.
