Back in October I received a letter from HMRC saying that my wife has not yet established the right to stay here in the UK permanently and that I'm still entitled to tax credits and still need to claim as a couple but im no longer entitled to the second adult element and that my tax credits have been reduced due to that.

I did some searching and came across a link to this forum with someone goin through the same situation but i cant find it anymore.

in that post it said that if the married couple were to have a child that i would once again be able to get the second person element back. My son was born on tuesday and i would really like some more info on this or a link to the original post.

(was claiming tax credicts for 6 month before as married with no problems)

(not reread it but...

if one person is elegible for TC / CB both are considered as having recourse for those funds.

this includes the second adult premium.

I had a letter off hmrc confirming this because when our assesment came we got almost 1000 extra because of my wife... i informed them that it needs removing because wifes nrpf, and they informed me due to a change in legislation for the purposes of tax credits my wife has recourse to public funds as i have recourse.
