Does Change of Sponsor (Employer) affect ILR eligibility?

Post by neeilk » Sun Feb 03, 2013 1:18 pm

Hi

Question:
1- Please someone guide me, if all factors being same; does the change in Sponsor affect eligibility for ILR?

I Came to UK on Work Permit on July , 2008 - Sponsored by Company A
Since then, my WP's have been extended, with same Company A as sponsor, as shown below:

Visa Type: T2SW (Intra Comp Transfer) Migrant :
Date of Issue: 11 Dec/2009

Visa Type: T2 ICT LONG TERM (LEAVE TO REMAIN)
Date of Issue: 29 Dec/2012

Background
So far my Visa has been sponsored by Company A, but the current Assignment is coming to and end in MARCH.

If I look out for Jobs, I am hopeful to get another Sponsor in UK, which I believe require me to re-apply for change in Visa although not sure which category.

Question:
2- Should I look to change company or stick with the existing company and risk not having an assignment after March?

I plan to apply for ILR in July 2013.

Many thanks in advance for any help

Regards,
N

P.S.
I have not been out of country for total of 180 days in 5 years.
I meet the minimum salary threshold requirements for ILR application.

Hi wpilr_nov12,

The 1st Work Permit was issued on May 2008. exactly 30 days prior to my I entry in UK.

I may be able to get a month's or 2's extension.. in current role. but NOT be able to get extended until July here.

I sincerely want to keep my eligibility and work to ensure my extension appropriately in right time(be it within the Company A or outside),hence this doubt to looking out or not.

Giving exact dates would help. If you got visa in May and you entered in July, it is more than 30 days in between.

Many Thanks wpilr_nov12.

I will double check my ILR documents and cross verify with the eligibility criteria to ensure there are no other gaps or issues.

Before I visited this forum, this ILR journey seemed impossible. I hope to understake it successfully with help/guidance from Sages/Gurus/members of this forum.

Background:
A: Queries Related to Form :
My Visa Sequence : WP + WP + T2 + T2-ICT
  • 1. Am I correct to Use Form Set(O) ?
    2. What will be my Category? Work Permit or Tier 2
I think I belong to Tier 2 Category as I'm currently on this visa, but in doubt as
As I had originally been granted a Work Permit Hence the confusion.
B: Missing Salary Slips
Due to some system errors, I did not get Salary slips for initial April'12 and May'12 months.
And I'm currently on Loss of Pay leave due to family reasons, hence did not get full month's salary last month (April'13).
My available salary slips should be able to substantiate minimum salary requirement as it also shows cumulative gross salary for the year
  • 3. Will 10 payslips be OK ( of last financial year), or do I need I provide something in lieu of the missing 11,12th month payslip?
C: Queries Related to Job Code Supportings:
My current Company will not give me a explicit letter stating my Job Code.
Hence,I plan to use a standard company letter provided for normal Visa processing, which states salary , job role, and date of coming to the country.
  • 1. In absence of explicit SOC Letter, will the above-mentioned document help?
    2. Is there any other supporting document that I can provide for the Job code.?
    3. My Job Role stated in last few correspondence between my company with UKBA shows Software Engineer - but my project Role is Application Lead in the letter. Will this be a problem?

Many Thanks.

Please forgive me, if I have duplicated any questions here.
I ask cuz i do not want to miss due to ignorance/not asking for help. and subtle changes in rules like new SOC codes/letter don't help.
