ILR dependant visa application

Post by saudbs » Sun Feb 03, 2013 7:50 pm

Hello everyone

I recently got my ILR from HSMP/TIER1 route. My wife was my dependent when I was on Tier1 visa. Her dependent visa is going to expire on 15/3/13.

I want to apply FLR for her, can someone guide me please which form to fill and what are documents to attach and what are the requirements ?

Thanks,

Hi saudbs. Is your wife completing 2 years by Mar 15? If yes, she can apply for ILR.

Abdul

If she is not eligible for ILR then PBS extension may be considered

She should extend her stay as a PBS dependent until she qualifies for ilr. The rules have been amended to allow for this.

Moreover, we would have had a clearer picture, if you had continued from an even earlier thread:

saudbs wrote:Thanks for reply all :), she got dependant visa on 21st july 2012 but we got married in UK in march 2012 and she was on student visa.

So she has stay in UK for 2 year before she goes to ILR or 5 years?

any ideas please?
CR001 wrote:5 years - it is not the date of marriage that counts, it is the visa issue date and as this was after 9th July, she will fall under the new rules.

If not FLR(M), then which form should we use to extend her stay on PBS dependant?

Hi Everyone

Thanks for your help. My wife got FLR(M) approved yesterday and we are waiting for BRP.

We got married in march 2012 (in uk) while she was on student visa, then she switched to tier1 dependant on 21 july 2012. So we fall under 5 years route for ILR.

But letter we recieved says "In order to qualify for settlement you must have completed a period of 2 years....."

Why they have not updated the letter to mention 5 years? not 2 years.

Thanks,
