Urgent response! if I have broken my continuous residency?

Post by siu_kitkat » Mon Feb 04, 2013 1:27 am

Hi All,

Apologise if this has been covered in here but so far I cannot find any case that is similar to mine. Sorry for the long message. Would be much appreciate if anyone can answer my question asap. As I need to send my ILR application out by the end of this week.

I am applying for the 10years long residence in the UK. I came in the UK in Sept 2001.

My problem is :-
1. I dunno if i clarify as broken my continuous residency/ onverstay??

In 2009, my Tier 4 student visa application was refused due to photo not meeting the requirement. Thing is at the beginning, I had sent my application out on the 18.10.09 before my visa expired on the 31.10.09. I got the letter from the UK border on the 1.11.09 which they gave me 28 days to resubmit my application. I had resubmitted my application in beginning of Nov (but I didn't keep the record of the date I resubmitted). I received a letter on 18.11.09 to book for my biometric card. My visa was granted on 4.1.10.

2. Does it matter that much if I cannot provide all the entry record during my 10 years residency??

I am holding a BNO passport which is a British National Overseas passport. I do not have all the entry record in between 2001-2003. This is because not all the immigration officer stamp on my passport. Is anyone can advice me what the best way to do please.

3. Does anyone know where I can find proof of entry clearance in the UK for people who are holding BNO passport. This is because I came to study in the UK in 2001. At that time, I only need a landing immigration stamp when I arrived. But in 2004, the UK border agency has changed the law. People who hold a BNO passport will now require entry visa.

4. Do I need to provide any bank statements or council tax bill?? As there is no request on the application I am not too sure of.

Kind Regards,
