ILR-Dependent Enrty Clearence visa from outside of UK

Post by sanjubala » Mon Feb 04, 2013 1:15 pm

Hi,

I got my ILR in Jan 3rd 2013, after completing my 5 years (from Tier 1 General Migrant - Highly skilled worker Extension visa). Initially my wifi and Child were with me in UK with Tier 1 (General) PBS dependent visa (valid until 15 Jan 2013), but due to my Family situation, my wife and child returned to india on Nov 2010 and still living there. Now i like to bring them back to uk in April, by applying ILR-Dependent visa, when i checked the UKBA site,

http://www.ukba.homeoffice.gov.uk/visas ... you-apply/

where it says,

"
You cannot apply in a partner category if you:

are the spouse or partner of a person who is settled in the UK or has British citizenship if their most recent permission to stay was under tiers 1, 2, or 5 of the points-based system; and
you do not qualify for settlement yet.

"
So that means, I have to go with VAF10 application form (Tier 1 Dependent applying for Entry clearance from outside UK).

I am little bit nervous whether this is the correct form, or i have to apply for my wife and child in different category, if so what is that form ?.

Thanks,
Bala
