Switching FLR-O to a Tier 2 Application

I applied for Flr O end of December 2012 for which I haven't heard so far. I was on a work permit for previous 4 years until Dec 2012 and have been in the UK for 9 years 5 months in the UK. Previous employer didn't give me enough notice in telling me that they wont be renewing contract, so I was advised to apply for FLR O category which I did by the help of a lawyer.

During November/December, i had an employer who wanted to hire me and as such they have completed RLMT etc. by mid january 2013.

Question 1: When i send the Tier 2 application, do i need to mention that I do/Don't want them to consider the previous application (bearing in mind, the lawyer put together a 100 document application as i did have good grounds and history etc.) Which option is better ?

Question 2 : Regarding payment, do i need to make another full payment for this application too, as there has been no decision made on initial FLR O application filed in December 2012?
