Tier 1 Absent from UK, Employment and Children citizenship

Hi Everyone,
Thank you for reading my post. I will make my question short and simple to understand. My questions are

1. Can I apply for ILR on 17th June 2013
I got my visa stamped as Tier 1 while in the UK on 17th July 2008

2. Will I be OK with the following absents or do I need to support all my absent with some form of documents
17th June 2012-2013: 16 Days
17th June 2011-2012: 37 Days
17th June 2010-2011: 91 Days
17th June 2009-2010: 78 Days
17th June 2008-2009: 94 Days
Total 316 days

3. Currently I am on a permanent employment, but when I will apply I would have left my job and may/may not be in employment. I do have enough funds as savings and I have already secured the required earnings for the 12 month period. Will my unemployment cause any issue?

3. Can I apply for British citizenship for my daughter after I get the ILR
My daughter was born in UK in 2011 and her dependent visa expires in August 2013. Is it safe NOT to apply for her ILR and only once I get my ILR I apply for her British citizenship.

4. My son is 9 years old and was born outside the UK. Can I do the same for his british citizenship? As in NOT apply his ILR and apply his British Citizenzship. He is in this country for more than 4 years.

1. No you cannot apply on 17 June 2013. Actually, you cannot apply anytime before the final 28 days before 17 July 2013.

Ok I get it, should be 28 days before so probably best would be the 21st June 2013 to be more safe.

Anyone able to answer my questions for point, 2, 3, 4 please

2. Looking at the annual breakdown of absences, they do not look excessive. But do recalculate, based on your new eligibility date to verify. An employer letter is not required to confirm annual leave or business related absences if applying as a T1G Migrant. But if any absences were due to serious or compelling compassionate reasons then you will need to submit a personal letter and evidence.
3. Shouldn't be a problem, as you are applying for ILR as a T1G Migrant. Your P60's may be used as proof of economic activity during the 5 years, if that question arises.
