NHS Low Income Scheme while on Spouse Visa

Is a person on Spouse Visa allowed to avail NHS Low Income Scheme? (NHS LIS). This basically pays for things such as visit to dentist and cost of transport to and from.

I'm self employed, no benefits, partner also on no benefits, partner unemployed.

is it listed in the immigration rules as public funds, I dont think it is.. Would have to look.

but: job seekers (CONTIBUTION BASED) is not a "Public fund"... my wife has "No recourse" but is entitled to full health care costs free due to our tax credits claim... (but im not sure if thats to do with the excemption that because im entitled to it, she is also etc...f

3.1. Public Services
3.1.1. National Health Service (NHS)
3.1.1.1. The Department for Health has its own regulations regarding whether or not individuals who
are not ordinarily resident in the United Kingdom can receive free NHS treatment. Treatment under
the NHS (paid or unpaid) does not count as public funds for the purposes of the Immigration Rules
.

3.1.1.2. Proposed treatment or evidence of treatment may, however, be a basis for refusal of leave
to enter or remain on other grounds in the Immigration Rules. For example, a person may be applying
for leave to enter/remain in a certain category under the rules when, in fact, they are primarily here to
obtain NHS treatment.

3.1.1.3. Where a person was given leave to enter or remain to have private medical treatment but
has had NHS treatment caseworkers should investigate whether the NHS treatment was the
treatment they obtained leave to have privately. If so, this may be a breach of the conditions of their
stay in the United Kingdom and refusal under the general grounds may apply.

Im not claim any tax credits, not even working tax credits.

NHS treatment is free, I know, but NHS LIS allows me to get reimbursement of costs incurred during travel to and from hospital, including dental treatment and free prescriptions.

well,... claim the free treatment, and avoid claiming other costs (travel etc)...

treatment is not a public fund... as to recieving money for travel, i am unsure...

also, i wouldnt hold your breath for cost of travel... after housing costs im below Income Support levels of money... but i cannot claim travel costs to and from hospital... despite attending 2-3 times a month n it costing a fortune. :)
