PSW Appeal refused - Spouse Visa

I arrived in the UK in December 2004 on student visa.

I extended my visa a few times and then I applied for for PSW visa on the basis of ACCA fundamental Levels in October 2011. I received the refusal letter from UKBA in September 2012, after 11 months. I then appealed against the decision in the First tribunal, which was not allowed. The appeal to go for the Upper Tribunal was not allowed either. I received a letter from the courts on 6th February 2013.

In the meanwhile, I got married to a British citizen in November 2012 and started to live together. She is working (14K a year salary) for the past 4 years. I started my new job in September (19K a year salary). The job I had before that paid next to nothing.

I can assure that it is a genuine relationship and we are willing to prove anything at all, if required.

I would prefer to apply for a spouse visa within the country because we have a wedding reception hall booked for September, holidays and everything else that comes with the routine for a newly wedded couple.

Could you guys kindly advise me what is the best option for me?
Is there any risk to my current employer?
I will be in the new job for 6 months at the end of February, hence, meeting the financial requirements under the new rules. But have I worked illegally?
What is my current status?
I have never breached any immigration rules before, of any sort.

Your advice will be appreciated a lot!

I've asked a solicitor and he says that I should apply for FLR(M) through the premium service and that I will be an overstayer by that time.

Could you guys please advise if this is correct? What is best option for me?
