Cooling off period from Tier-1 to Tier-2

Hi All,

I was on Tier-1 visa working for an Indian company in UK and returned from UK on April 3rd 2012 and my Tier-1 visa expired on April 5th 2012.

Now my employer is planning to process Tier-2(Short Term). Our company's Immigration group came back saying that i need to spend one year in India before i can apply for Tier-2(Short Term) visa.

As per my knowledge, the cooling off period applies if we are applying for the same category of visas i.e. Tier-2(Short Term) expired and the cooling off period applies if i want to apply the same category of visa again.

Could anyone confirm if my understanding is correct and any other thoughts are welcome.

There is no cooling off period where the applicant has previously been in the UK under Tier 1. I suggest you revise your question.
