Am I entitled to Irish citizenship?

Post by EEB » Mon Feb 11, 2013 11:53 am

My father was born and had his birth registered in Ireland, by Northern Irish parents. Do I hold a legitimate claim to an Irish passport, and his my father's birth certificate the only piece of documentation that I would need to prove it?

I think you do hold a legitimate claim to an Irish passport. I dont think your fathers birth cert is the only evidence that may be asked to provide. If his name and details are clear enough on your birth cert, then that may be the case, but if not, they may ask for sample of DNA etc
I oppose stereotype, prejudice, xenophobe, judgmental, Ignorance, and beloved.

You are an Irish citizen, you should make an application with your fathers birth certificate along with his passport. DNA sample are extreme and should normally not be required in your case.

You will need:

1. Your father's birth certificate
2. Your own birth certificate, with his name listed as father.

You do not need your parent's marriage cert, but if it is available you might as well include it. The child of a married woman is automatically that of her husband, under Irish law, so if you have their marriage cert, this removes doubt as to your paternity.

If you are the child of unmarried parents, or if your father's name is not on your birth cert, then you could provide DNA evidence if the passport was refused.

This would be rare and is usually only an issue when a non-Eu father looks for permission to remain in Ireland on the basis of being the parent of an Irish citizen minor child. The citizenship of the child in these cases is usually clear (the mother is Irish) but there have been cases where the paternity of the man was questioned, as he benefitted greatly from the birth of the child. This is usually why DNA evidence is requested regarding paternity and immigration.

I can confirm that you are entitled to Irish citizenship from birth, since your father was born on the island of Ireland.

Just to add to the other comments on this thread, since you are a first-time passport applicant, you will probably be asked for further proof of ID, utility bills, photo ID, etc, etc

I can also confirm that DNA testing would be a very rare extreme request where there is signifigcant doubt about an applicant's link to the father or the about the applicant's identity.
