visit visa approved for 2 years with a max stay of 6 months

Post by lapen123 » Tue Feb 12, 2013 12:09 pm

I need your advice about my in laws visit visa.
They've got 2 years visit visa today with a max stay condition of 6 months. My questions are:
1)is there any way of extending their stay in the UK after 6 months of their stay?
2)if they have to go out of the UK after 6 months, will they have to go back to their country of origin or they can go to any european country for couple of days and enter in UK again for another 6 months?

Thank you for your help!

1. No.
2. They can try but there are no guarantees they will be re-admitted. They are not business travelers who need to come and go for good reasons; they are old people, presumably not working, whose family live in the UK, and it would appear they merely prefer to be in the UK with their family rather than at home, so it will be suspicious. It's not permitted to effectively live in the UK as a visitor so the officer who greets them will be very wary of their intentions of returning so soon after a previous and long visit. If they are admitted they may stay for six months, but their next visit had better be a very long time after that.

I concur - and if anyone spends more than 6 months in the UK in a calendar year they effectively become a "tax resident". It is not permitted to stay in the UK over 180 days in any calendar year. In fact if they say they're staying for a full 6 months in the first place immigration will be suspicious and will want assurances about their finances and their intention to leave.
