Urgent : ILR or FLR (M) for my dependent(wife)

Hello Guru’s,
I am main applicant (visa category: HSMP +Tier 1 general) applying for ILR on 22-FEB-2012 by PEO.I am not sure whether my dependent (wife) is eligible. She has been in UK for nearly 3 years but initially she was on work permit for 1 year working in different location to mine, and remaining period as my dependent (Tier 1 dependent visa) and staying together .
Work permit period: 1 July 2010 – 18 May 2011
Tier 1 dependent Visa period: 18 May 2011 – Till date.
She went to India for changing visa from work permit to dependent during April 2011 for a month.
I have cohabitation documents proofs for the period as my dependent.
Could you please suggest if she is eligible for ILR or do I need to apply using FLR (M).

She is eligible to apply with you.

As you said ... she was working at different location ... it means you don't have any cohab doc proof during that time period right?
Basically you have to show some address proof for 2 yrs .... if you can then she is eligible if not then wait for 2 yrs completion ... it doesn't matter whether she was on WP and dependent visa ....
