BC eligbility

BC eligbility

Hi

Q1) I got my ILR in Oct 2012 and I might be moving out of UK [for long term] in Jul 2013 so just to play safe I am thinking if I ever want to come back to UK I should sort out my BC.

So my question is lets say if I move out of UK in Jul 2013 and wait for another 3 months until Oct 2013 [thought being outside of UK] and then apply for BC from outside of UK ?

I am aware of 90 days rule in last year so therefore if I leave in Jul therefore keeping less then 90 days do you think I will still be eligible for BC ?

can you guys think of any issues which could be a potential problem.

Q2) lets say if I am probably over 90 days outside of UK [incase I leave in Jun 2013] can you suggest any way I can still apply for BC ? or there is no way.

When you say I should be present in UK , do you mean living permanently [residence] ? Can I not apply it via Post ? give communication address of my relatives in UK .

thanks , I was not sure if I should reply to that post but it quite old now so I have pasted it below.

You said answer on 2.3 could be an issue if someone intends to live outside of UK. Well of course the intention is in the long run [may be 3-5 yr] I would like to return back.

On practical side an intelligent answer would ALWAYS be to say "Yes" I have intention to live in UK. how will HO knows what could be my intention, would it be not stupid of me telling HO now that I might be out of UK for next 3-4 yr then they will surely reject my application.

All I am trying to find out is am I missing a point ? obvious answer will always be yes.

If the job is for 6 months (or less), you should be fine otherwise you will face an issue with meeting the future intentions requirement (see 2.3 there).

The HO will not grant naturalisation to people not intended to be part of the UK in future.

I'm just saying what the rules are. Not how to answer questions on the form.

It's impossible to know about one's future intentions but if an applicant applies after working some months abroad, questions might be raised.
