Hi all I have been reading lots but not found a situation like mine. I have an Ilr and my partner of over 2 years has 5 year retention of rights having been divorced from an eu partner. Our boy was born in my home country and I left him with my mum. We want to bring him over now and according to what I read both parents must have settled status. I will be the sponsor but under what category should I apply because my partner does not have Ilr? Do we still qualify to use vaf4 or what? We are not married yet and how does that affect my application for our boy. Pleaseeeee advise is needed urgently

I believe paragraph 297(i)(F) should be in play at the worst.

I am sure if you explain the situation properly, form VAF 4 should succeed.

At the worst, he should be given a leave consistent with that of the mothers Residence Card.

Well if the child in question is adoptive, then my initial advice is incomplete, and you may have to overcome extra hurdles.

Hi guys. My partner owns the house but I have more liquid cash and want to be the sponsor on the form vaf4a. Can I just be the sponsor or does my partner have to provide the documents like me? Your replies will be appreciated since the form looks like only one sponsor is required. Themks
