Im new to this forum. so forgive me if I put my post somewhere where it shouldnt be.
well i just need some advice on what me and my husband are going threw.
in June 2012 my husband had to go down Bogota Colombia to apply for his settlement visa to come to the UK. As his home country (Honduras) doesnt have a British Embassy. We had a few hiccups at the start with the lawyer because she put our application together and told us what to do( as weve never been threw this before.) Our lawyer at the time told us to book an English test with Cambridge ESOL. So we called up Cambridge university in January 2012. They told us there wasnt a test centre based in Honduras. So our lawyer told us to get it in written. So we did. Our lawyer said because my husband has a diploma from the USA and have lots of paperwork to show the ECO mine and my husbands convos all in english. she said that would be enough( as we trusted our lawyer with what she said because shes an expert). anyway
September 2012 we got our notice of refusal. We was heart broken. The ECO refused my husband on 3 things.
1. English test
2. My parents debt( in the name of a mortgage)
3. My income
we are really confused because my income i put in my husbands application my payslips and my bank account with savings in it.
plus my parents are in debt. they are paying of a mortgage on their home. which takes 16% of their wages a month. so they have 84% money left after the mortgage.
and we understand about the English test. we was stupid to trust that lawyer!!
now weve appealed it and had the notice of reciept from the courts. my dad wrote a really good review letter for the ECM.
we also sent of my husbands english test results as he took it when he was in colombia.( our lawyer told us we could only take it in my husbands home country). we found out different. so my husband took it and passed it with a high B1. we alway included my payslips from my new job as i started a new job in November 2012. plus the Cambridge university letter to say we did try and get my husband in an english test. and one last thing a job offer for my husband.
Our new lawyer said she just had two cases the same as mine and my husbands. and both of them cases the ECM overturned both of their decisions.
its been 15 months now that me and my husband have seen each other and its really getting to us. Can anyone please give us a time frame or any advice on this?.
we pleased them on everything else. etc geniune marriage, good home for an extra person.
