Applied for Flr(M) but ask to apply for PBS dependent

Hi,

I got my Ilr last month frm Tier 1 (G) and went today to apply for my Wife as FLR(m) as she has completed 2 year with my. But the PEO ask to apply as PBS dependent for her and once 2 years is up apply for ILR.

Is this correct. As I am totally confused.

Please advise.

Did you get your ilr after 5 years as an economic migrant or under the 10 year long residence route?

Well person is wrong. You should have insisted that FLR(m) is the most appropriate form, as you are no longer a PBS migrant, but a settled person.

The person was right actually. Para 319E allows for extension as a PBS dependent after the main migrant has ilr and is the most straightforward route.

Interesting the rate at which these changes takes place.

I believe that change is one of the few favourable changes in the immigration rules, and it makes more sense than the previous system.

This has been the case for a few months now. note it only applies where the main migrant has obtained ILR as a PBS migrant (e.g. after 5 years in the relevent categories). If the main migrant has obtained ILR under the 10 year long residence route, the old regime of having to apply on FLR(M) then SET(M) applies.

I have been mainly focused on the FM route lately, and lost sight of these slightly positive changes for PBS dependants.

I was aware of the suitability requirement, that they are subjected to.
