hello

I need some help as read all advices and instructions and still not sure what should I fill in that form.

I am Polish (EU member) alone in the UK (8 years) no family etc all the time employed (4 different employers), wanna apply for a permanent resident.


- 1.5 Your full name as in your passport: on passport I have name and surname, but In reality I have a middle name too, should I write that middle name in 1.7 Any other name(s) by which you have been known ?


- whats the home office reference?

- I assume I dont have fill in section 2.3.4.5.6


- section 7 - there is 7.1 where is a small box employment - do I write all employers there?
and there is point 7.3 do I have to write all 4 employers again?

7.3 If your EEA national family member exercised Treaty rights in employment, self-employment
or study, please give details below starting with the most recent if there is more than one employer and/or place of study. Continue on a separate sheet if necessary and enclose it with this form.

- 8.2 days outside UK ( am I right? if I was on holiday 14 days I have to write 12 days as a number of days as it says do not include the day of departure or the day of return

- what should I write as a number of days spent outside UK if I was in Paris 14-15 JULY and I dont include arrival and departure 0 or 2?

- 9.12. DONT UNDERSTAND that point at all do I have to write Social cultural or family ties from my country?

Please state what ties you have with;
• The country where you were born POLAND
• Any other country whose nationality you hold NONE
• Any country where you have lived for more than 5 years POLAND
You should tell us about any family, friends, or other connections with that country.



- can I print out all that EEA3 BLACK AND WHITE?


thanks a lot for your help, I am just confused and want to fill in the form correct, I know there are lost of guidances etc, but still its not clear

Remember that you don't need to use the form at all. The only important thing is that you lived in the UK in accordance with the regulations for the required time (generally five years).

I note you are Polish. Did you register on WRS?

yes I am Polish, bud I dont have a WRS as when I applied for it in 2007 they told me that I dont need as I worked and lived at the same place so i wasnt qualified for it, I have that letter to attach to this application.

If not self-employed, lack of wrs may cause you problems.

I have a letter from WRS telling me that U didnt have to have it as I worked in a live in position

Well, there are 4 categories of people who were exempted from the WRS, and these are:

Workers that were exempt from registering on the scheme included:

those who were self-employed
those who were working legally in the UK already in the same job that they held on 1 May 2004
those who had leave to enter on the SAWS scheme before 1 May 2004 and had started working in the UK under the SAWS scheme on or after 1 May 2004
those who were providing services in the UK on behalf of an employer who is not established in the UK.


You dont seem to fall into any of this categories.

It would be interesting to see the letter that WRS sent you. They probably thought you were self employed.

I am really unclear about your question. It is pointless advising on form, without first establishing your eligibility.

You may want to seek legal advice.

I applied for WRS in 2007 and I got a letter confirming it plus I have a letter saying that in my case when I do a live in position I am not required to register on WRS. So in my case Government couldnt give me wrs thats why I dont have it


going to send them 2 letters along with application

according to law there if u work in as a live in position, u are not required to get wrs

Which law. I have never heard of it. Were you working in a domestic household or not. Even the seasonal scheme agricultural workers require WRS.

I think it was a mistake the made, provided you explained your circumstance properly and sent your work contracts and everything, you could challenge a refusal.

i got me scared now, I got the letters confirming immigration .... didnt give me a WRS and I cant do anything about it.

will i have any problems with HO that i dont have wrs or fines? its not my fault they didnt give it to me and sent passport and a refund

I don't understand the term live-in worker, but it is certainly not covered in the law, governing A8 national under The Workers Authorisation Regulation 2004.

if someone is exceptionally talented and special doesnt have to have WRS and it doesnt have to be written in law, I got a written confirmation from HO that i didnt have to have wrs!

I advise you to study harder before u post comments

Well, all i can say, is that in policy and law, an A8 national who is a worker, has to do so in accordance with the WRS. The is no exemption clause for so called exceptional talent.
That is a concept found in the immigration rules.

Page 3-4 of their own policy.

Except you were self-employed or was working legally before A8 became EU member.

I believe you have a strong case to succeed, as you were misled, but the advice you were given is 100% accurate.

We can only go by law and policy, which governs the land. We cannot speculate on an unknown policy, which even the courts are unaware of.

Hi everyone,

I actually also have a question in regards to filling out the EEA3 form and can't seem to find any help on this... :(
I am from Hungary and only applying for myself in the form,without any family members.

Do I need to fill out section 7.3 then?? It says "If your EEA national family member exercised Treaty rights in employment, self-employment or study, please give details below starting with the most recent if there is more than one employer and/or place of study....etc." it is not saying If you/your EEA national family member (and nearly all the sections in the form start like this, including you and your EEA family member)... so do you think I should leave it blank??
Or they just made a mistake maybe and I should still fill it in?

I am ready to post thecapplication with all the supporting documents but nearly not sure what I should do with this section :(

Please any help would be greatly appreciated!!!

No need for section 7 if only you apply. I assume you were registered with WRS (or self employed).
Check the FAQ before posting!

Yes, I do have WRS certficate.

Also, just one more quick question, how could I prove my residency the best way? (I don't have contracts/tenancy agreement and did not have to pay any bills as it was all inclusive in the rent for a short period within those 5 years..)
Do you think if i print out 5 years bank statements that would be ok? (Even though my past addresses woudn't be on the statement..)

Your P60s can also prove residence. Or get a letter from your employer confirming you worked in their offices in the UK expect to xx days of holiday a year.

Hi I am also from Poland I come in 2006 year with my wife and we apply for WRS after 1 year we apply EEA1 form and we get residence document.2008 and 2011 my child was born in UK but just one has british passport.
Question

1-I have to apply for permament residence document EEA3 form if I want stay permament in UK?

2-How many family member should include my form if I planning apply for british citizenship when my older child reach 10 years old,or I should apply now in EEA3 for 4 family member?

3- I have continous 8 year work history and have P60,payslips as well but my wife has 2 working breaks when children born,also she left UK for 6 months in 2009 year to finish Master Deegree in Poland and now she confirm that in QTS service and get right to teaching in UK.She can get permament residence EEA3 if she has that study break in Poland?
