Council tax benifit can my husband claim

Post by Tik » Sat Feb 16, 2013 12:09 am

Hi
Hello

My husband is a British and settled, we have 2.5 year old daughter British also.
I am Thai and have been here on my setm visa for 2 and half years on that time i have raised our duaghter while my husband worked. in October we applied for my ILR

My husband has been out of work for 3 months and From what I understand is he can claim houseing benifit for himself and our daughter (private tennant)but we are not sure if council tax benifit, he did recive a credit note for council tax benifit after he sent in the forms.

Is this a mistake or is he allowed to claim council tax benifit ?

Crazy as whe he took all the forms in had photo copies of my passport that shows no recourse to public funds but they didn't take them as was not a original document

Very worried this could effect my ILR

I believe but please wait for confirmation of someone else on the forum your husband is more than entitled to claim Council tax benefit for himself and your child as they are British citizens BUT he must be the main claimant and state that you are living there have NO RECOURSE TO PUBLIC FUNDS and declare any income you may have coming in.

and ask to be paid the single rate of benefits for himself and your child state you do not want any extra money because you are there BUT YOU MUST BE ON THE CLAIM.
