How to change my spouses status from ILR to spouse of EEA

Post by andy004 » Sat Feb 16, 2013 12:53 pm

Dear all

Newbie here..

I have obtained british citizenship. However my wife has decided to keep her Sri Lankan passport. This is due to Sri Lanka does not allow dual citizenship at present. She has ILR for over 12 months now and obviously eligible for naturalisation.

My question is does she need to change her immigration status to spouse of EU/EEA to travel in EU without a shengen visa? Or has she already acquired such status already since I changed to british passport?
If she does, how can she change her status? Which form to fill?
It saves us lot of time going for visa interviews

She always travels with me in EU.

I just dont want her to be turned away at the airport without a shengen visa.

Many thanks in advance for your advice.
Much appreciated

As the wife of a British Citizen (not a national of another EU state) she will continue to require a Schengen visa unless she herself has British Citizenship.

Hi Casa
Many thanks for getting back.
I personally know one sri Lankan married to a british. He only has ILR and he goes everywhere in EU without a visa. He is even divorced now.....
I must say he got his ILR status over 6yrs ago. Were they giving ILR with different rights those days?

Many thanks

Andy
