Hey

I have posted this question before but posting again because had a word with someone and he told me differently.

I applied for spouse visa refused for partner to join me. Lodged appeal from within uk earlier this month.

What i want to know is when will the entry clearance manager look at my papers and make a decision to either overturn or lodge for appeal?

There is no set time just within 19 weeks they can look at your case and either reject or overturn.... What's ur mate say. What happened to his appeal.

Court date: 10 jan 2013
call letter: 08/03/2013

A solicitor told me that when you get the letter through from the tribunal that you will again here in 19 weeks then that means the entry clearance manager has looked at the papers and decided not to overturn the decision and that is why it will proceed to appeal

Of course. So they have up to 19 weeks to overturn if they choose to. If you don't hear anything in 19 weeks then yes tribunal will give you a court date, as that means they didn't over turn.

The ECM dies as they wish, depends how busy they are. But they can send you a rejection before 19 weeks aswell. The 19 weeks is just tribunals deadline.
Does it all make sense now. No one know when the ECM will look into the file you just have to wait. There are some people who wait 19 weeks also get a court date but suddenly get over turned.
