ILR need guidance on <180 days document proof

Post by mptj » Mon Feb 18, 2013 1:23 am

I am planning to apply for ILR, initially I was on work permit and later switched to Tier-1 so in total I have spent over 5+ years in the UK. Now as per 5 years continuous residence qualifying requirements I was less than 170 days outside UK (in total 05 years) mainly on holidays or family visit and really not sure what document proofs I can submit/ provide except passport. (I was absent from UK for 36 days while I was on Work Permit and rest 140 days on Tier-1 in total 5 years period so not sure about document proofs)

I would appreciate your kind advice and clarification on the below again regarding <180 days absence evidence/proof:
1.
Form SET (O) section:6 (clause 6.2) what date of entry should I fill either first ever entry date in the UK OR date according to the qualifying period And also what documentary proofs for my absence (in both cases of work permit and Tier-1 status)?

As per Below statement (copied from SET-O form):
Evidence of all work-related absences (including paid annual leave) is required from those applying under Tier 2 (Intra-Company Transfer);Tier 2 (General); Tier 2 (Minister of religion); Tier 2 (Sportsperson); Tier 5 International Agreement, and permitted employment categories - except Highly Skilled Migrants.

Evidence of absence due to compelling or compassionate reasons is also required from all of the above categories, and those applying under the Tier 1 (General); Business person; Self-employed person; Investor; Innovator; Writer; Composer, and Artist categories.

Second (copied from 'Indefinite leave to remain – calculating continuous period in UK' guidance)

Absences must be for a reason that is consistent with the original purpose of entry to the UK or for a serious or compelling compassionate reason in the following categories including work permit holder.

Absences must be connected to the applicant’s sponsored or permitted employment, or the permitted economic activity being carried out in the UK, for example, business trips or short secondments. This also includes, if appropriate, any paid annual leave. Evidence in the form of a letter from the employer setting out the reasons for the absences, including annual leave, must be provided.
Compassionate reasons will vary but can include serious illness of the applicant or a close relative, a conflict or a natural disaster, for example, volcanic eruption or Tsunami. Evidence in the form of a letter from the applicant setting out the reason for the absence and documents of support must be provided. For example: medical certificates, birth or death certificates, evidence of disruption to travel arrangements.

In the following categories, absences must be for reasons connected with the applicant’s purpose for being in the UK or for serious or compelling compassionate reasons. Evidence, as specified above, must be provided for compelling or compassionate reasons only:
UK ancestry, business person, investor, innovator, writer, composer, or artist, retired person of independent means, Tier 1 (General), Highly skilled migrant programme (not applying under Appendix S of the rules)

Do I need to provide any proof of holidays (both work permit+Tier-1 period)? and which ones?

My apologies if I am sounding complicated, please let me know if you wish to know more specific details.
