I have an urgent question and would be grateful if someone could help ASAP.
I am applying for settlement using form SET(O) (after completing the 5 years period). I am currently holding a Tier 1 General visa that was issued to me on the 26th March 2010 (this is a 3 year extension visa, expiring 26th March 2013), but before that, I was holding a 2 year HSMP visa since October 2007.
I am claiming 30 points in the Qualification section (Bachelor degree), but when I got to Page 26 on the form, I came across the following:
"You can only claim points for a Bachelor’s degree level qualification if you have previously been granted leave to enter or remain as a Tier 1 (General) migrant under the rules in place before 31 March 2009 or after 5 April 2010; or as a Highly Skilled Migrant, Writer, Composer or Artist or a self employed lawyer.".
What I am not sure about is that whether the above statement applies in my case and will wipe out my 30 points?
I used the point based calculator and it does ask you when you first successfully applied for Tier 1, and again I am not sure whether to enter the date when I first successfully got HSMP (the date for this as described in the provided calculator help is 29 february 2008) OR enter the date I got the extension 3 years visa,i.e. the 26th March 2010.
When I entered the 29 february 2008 I got 30 points, but 26th March 2010 I got 0 points.!!
Any help/support will be hugely appreciated!
