I am just wondering if someone could help us out
I am an Indonesian citizen, and I am engaged to my partner, who is an Lithuanian national, working and living in London. In March we will be getting married in New York City, one of the few states in the US which do recognises same sex marriage.
In July or June, I will be applying for an EEA Family Permit to visit my partner regularly in London, as I will be studying in Vienna, Austria. I am just wondering whether the UKBA recognise New York City same sex marriage as an official legal overseas marriage therefore allow us to apply for the EEA Family Permit? We have spoken to two immigration advisors and they give different answers, one arguing that New York same sex marriage will not be recognised by UKBA due to it not being recognised nation-wide, only in some states in the US. She also argues that New York is not listed in the Partnership Act 2004, which has a list of countries whose overseas marriage is recognised but it is annoyingly very outdated!
Would you be able to give some information regarding this? Currently super confused! I have contacted/emailed UKBA, British Embassies in NY & Indonesia, UK etc. No one seems to be responding!
