switching from PSW to tier 4 visa

Hello,

I am on psw work visa will expired in june 2013
I have PHD offer start in May 2013 the course research until May 2018.
I have been in UK since Aug 2004.
from Aug 2004 until Aug 2008 been on diplomatic visa as dependant. however I was studying English programme and Done 2years bachelor degree within that visa . then I had to go for 2 months to my country to switch from Diplomat to student visa.
I have been on student visa from october 2008 until April 2011 done my final bachelor degree and master
then PSW from June 2011 until june 2013.

my question is with the new rules... Can I switch from PSW to Tier 4 doing PHD research which may last for 5 years??

IMO if you are doing PHD then the maximum stay limit is extended upto 8 years in total. The studies you undertook when you had diplomatic dependant visa do not count towards the maximum period allowed. You have only used 2 years and 6 months so far, provided your Phd course is for another 5 years, you should be fine. Hope this helps.
