adult son of UK Ancestry now doing SET(O)

Post by SAmum » Thu Feb 21, 2013 12:26 pm

Hi Please can you give advice. I entered the UK on 4 year ancestry (British Grandmother) from South Africa on Sept 2005. Applied for and got UK Ancestry in Nov 2009 valid to Nov 2014. I am now eligible for ILTR which I am doing at the PEO in March. My son (not eligible for Ancestry as this only extends to my generation) is now 22 and has a Residence Permit (Limited leave to remain to Nov 2014 as he was still in college when our first visa's expired so got this as my dependant). He is no longer studying and has been taking care of my daughter and running the home while seeking work so is still dependant on me. Can he still apply as my dependant? if not what happens to his current reisdence permit if my I get ILTR? any help and advice would be great as I would be utterly devastated if my son could no longer live in the UK, especially as all my family are or have immigrated here. Thank you.

He should be able to apply as your dependant after the 4 years, as he was issued before he turned 18, provided he continues to meet the requirement attached to the visa.
