Visa for dependant spouse (aged 17)

Post by kag8 » Thu Feb 21, 2013 2:07 pm

Hi,

Just needed some advice. I am currently on a tier 2 general visa, having been granted this on Sept 2012.

I am getting married in a few months, and would like to bring my wife as a dependant.

My query is regarding her age, she is 17. I am 21. In my country of origin, this is totally legal and acceptable. Her parents have even offered to write a letter of consent if needed. Just wondering whether her age would cause any issues for her obtaining the dependant visa?

As far as I'm aware, if I was a british citizen/passport holder, then it would not be allowed as she would need to be 18. However, Im a points based migrant, so it shouldnt apply to me right? At least I can not find any such restrictions on HMRC website and immigration rules part 8 for points based migrants.

Any clarifications would be much appreciated.

Para 39 of the policy guidance.

39. In order to be granted entry clearance as a spouse, civil partner, unmarried or same sex partner, you and the main applicant must be aged 18 or over on the date you are due to arrive in the United Kingdom.

Oh no! :(

Thanks for your reply btw.

Any ideas on which visa she should apply for until she turns 18 and qualifies for dependant visa? As the wedding arrangements are almost complete, and living apart for a year is not an option.

Visit visa is for only 6 months I believe. Please help.

Thanks

She would only be eligible for a child visit visa but given her situation it would be refused.
