What is the best possible way to get the permanent residence for the Non Eu national in the following circumstances:
June 2008 Eu national started exercising treaty rights in the Uk
August 2008 Eu national married to a Non Eu nation in the UK
June 2009 Eu national granted EEA 1
September 2009 Non Eu national granted EEA 2 for 5 years till Aug 2014
May 2011 Child born in the UK
February 2013 Starting Separation
**** Eu national was exercising treaty rights as a worker and self employed till February 2013 but it will be expecting to stay as a single mum and starting claiming benefits like income support and housing benefits on the other hand the non Eu husband moved out but still in full time employment. No divorce procedures are in place yet.
**** Which route it would be applicable for the non Eu husband to get the permanent residence in this situation ???

If EEA national cease exercing treaty rights now, she will not qualify for Permanent Residence, and neither will you.

The earliest time she can cease work is June 2013.
