Irish Nationality from Northern Ireland.

Post by adl » Thu Feb 21, 2013 11:30 pm

I wounder if someone could help me please.

I has been living, working full time and paying taxes in Northern Ireland for last 5 years. I am living in Northern Ireland under UK immigration laws but I have heard if someone has been living in Ireland/State (does not mentioned Re public of Ireland or Northern Ireland) for last 5 years legally, he/she entitle to apply Irish Citizenship.

Could you please advise me, am I eligible to apply Irish nationality?

You are eligible to apply for naturalization, ROI still considers the NI as part of it's territory and legal residence acquired whilst living in NI is accepted towards the Irish naturalization

Absolutely not..............where do you pay your taxes? Just because you live on the island of Ireland does not entitle you to citizenship.

There are two states. Ireland (Republic of) and Northern Ireland which is part of the UK. You have to recognise the difference between the state and the geographical name of the island.

Regards,
Kindly explain how it is incorrect? you only said it is incorrect without further proof to back your claim.

People who have ILR in the UK and who lives in NI when give birth have gone to register their child as Irish citizen without problem, also spouses of Irish citizen who lives in NI have gone on to naturalised as Irish. what is your claim?

The OP does not mention anything about a child being born in NI or being a spouse , these are separate issues......... it is about getting Naturalised, as a NI resident, to obtain Irish Citizenship which is impossible. I have provided links as to how one can go about getting Naturalised in my reply to the OP.
There are various categories towards Irish Citizenship but I have never heard of someone resident in NI, pays taxes to the UK government has ever been Naturalised as Irish citizen (based solely on residency in NI), I could be wrong.

Perhaps you are correct on that and that was a mistake from me, residence of this kind are not accepted as reckonable residence towards Naturalisation. But that is not to mean it doesn't in some cases, if someone is married to an Irish citizen and resides in NI and paid taxes in NI, their residence in NI is counted towards naturalization.

Same as ILR holders, there children are automatically Irish citizen albeit born in NI.

The good Friday agreement makes it possible to do so.

Good that you acknowledge that mistake on your part.................... a bit of Google is helpful.

Yes for a child born to someone with ILR is entitled to Citizenship and spouse of Irish national resident after three years residency can apply.

But anyway, this is besides the point the OP was asking about.

Thank you very much for your reply.

I am still bit confuse, as I spoke some solicitors about this query some says no, you are not entitle to apply Irish Naturalization but some says you may be entitle to apply.

They mentioned that Irish Legislation cover whole Island of Ireland not only Republic of Ireland...

Could anyone have any Idea about it??

I genuinely dont think that there is no way you are eligible, but you can always write to INIS to found out.

The best way is to write INIS and take their answer for it.
