On 26 July 2012 1 month before the 25 August 2012 which my
Discretionary Leave expired. I had applied in time for a Leave to
remain on HPDL form as I made as it had "Discretionary Leave" on it,
did not received a reply from the UKBA until the 5 December 2012, with
UKBA dated 26 November 2012 saying the application was invaild.
My husband decided to help me to apply using the British Citizen by
British Nationally Hong Kong Act 1981 as I always considered myself as
one. So we applied on the 7 December 2012
We got our reply on the 31 Jan 2013 the case officer mention that he did
consider my application under section 4(2) of the British Nationality
(Hong Kong) Act 1981 which he stated that he could not register me as
my "Discretionary Leave" had expired on the 25 August 2012,
requirement at paragraph 3(d).
If case officer had looked at my file he would of seen that I had applied
on the 26 July 2012 and that I was still in my 28 day period as my last application was invaild.
I have made a complaint on that technicality via the UKBA complaint
email on the 31 Jan 2013 and today is the 22 Feb and still not a formal
reply either by post or email that they are dealing with my complain.
I did resent the complaint by email again yesterday and added that I hadnt a reply in the 20 day which is stated on the UKBA website.
Do I wait? Is there away to find out via phone is they are dealing with my complaint?
